§ 57. Construction permits.

Neither the franchisee nor any affiliate shall construct or install any telecommunications facilities within the County without first obtaining a construction permit therefor, provided, however, that:

(A)

No permit shall be issued for the construction or installation of telecommunications facilities within the County unless the telecommunications carrier has filed a registration statement with the County pursuant to this Ordinance.

(B)

No permit shall be issued for the construction or installation of the telecommunications facilities within the County's property unless the franchisee has applied for and received a franchise pursuant to this Ordinance.

(C)

No permit shall be issued for the construction or installation of telecommunications facilities without payment, as provided in Section 24, of the construction permit fee established in Section ___.

(D)

The Director of Public Works may suspend or revoke any permit issued by the County Engineer or take any action deemed necessary including the stopping of work, should the franchisee violate the terms of said permit, until said violation has been corrected to the director's satisfaction.
