§ 8-813. Shelby County short term rental appeal board.

  • (a)

    The Shelby County Short Term Rental Appeal Board is hereby created, and authorized to hear any appeals filed by any short term rental property owner related to a denial, suspension, revocation or nonrenewal of a short term renal permit issued by the county clerk's office.

    (b)

    Membership of the board shall consist of the county fire marshal, the county building official, a designated representative from the county sheriff's office and one from the county health department. A representative from the clerk's office shall act as administrator for that board. The county fire marshal shall be designated as the chairperson for this board.

    (c)

    The board shall conduct regular or special meetings at such time and place as may be determined necessary by the chairperson and all such meetings shall be open to the public with proper public notification. Three members of the board present for the meeting shall constitute a quorum for the transaction of business.

    (d)

    The board shall keep proper records of its proceedings and written notice of any special meeting of the board shall be given to the members at least 24 hours prior to the date set for such a meeting.

    (e)

    The board shall be authorized to purchase all necessary stationary, printing and supplies through the county clerk's office from funds generated by the fee established by this article.

    (f)

    The board shall hold hearings regarding appeals by owners of the denial, suspension, revocation, or nonrenewal of short term rental permits. If the board determines that a permit should not have been denied, suspended, revoked or should have been renewed, such a determination shall be submitted in writing to the county clerk's office for proper action.

    (g)

    Applicants shall have the right to appeal any decision of the county short term rental appeal board pursuant to T.C.A. tit. 27, ch. 9.
