Article XVIII. SHORT TERM RENTAL OF RESIDENTIAL PROPERTY |
§ 8-809. Denial of a short term rental permit.
(a)
The county clerk's office shall have the authority to enforce this article, including the authority to grant, deny, suspend, or revoke short term rental permits.
(b)
The county clerk's office shall notify the applicant by certified mail of the denial of an application for a short term rental permit within 15 days of receiving a complete application. The notice shall cite to the applicable law or Shelby County Ordinance provision and describe the reasons for denial with specificity. The notice of denial shall also inform the applicant of the right to request an appeal to the short term rental appeals board.
(c)
Any applicant shall have the right to appeal the denial of a permit to the Shelby County Short Term Rental Appeal Board. The denied applicant shall make the appeal within ten days after receipt of the denial by filing a written notice with the board and a copy of the notice with the county clerk's office. The board shall act upon the appeal at its next scheduled meeting, or within 45 days of its receipt if there is no scheduled meeting before that date.
