§ 44-93. Prosecution by peace officer or private citizen; citations.

  • (a)

    Prosecution for a violation of this division may be initiated by a peace officer who witnesses an offense in violation of this division or who discovers an article bearing a person's name upon the property of another, or upon any public highway, street or road, upon a public park or recreation area, or upon any other public property, except that designated for that use, or by any private citizen who witnesses an offense or discovers incriminating evidence, who is willing to make the initial charge and testify for the county.

    (b)

    The peace officer or any special deputy employed by the health department who witnesses the offense may issue a county ordinance citation as the charging instrument for any violation under this division by having a summons issued by a court clerk.
