§ 36-83. Construction activity.

(a)

All construction activity, defined in section 36-3 of this chapter, shall be in compliance with all applicable requirements under this article.

(b)

If one or more acres of land are disturbed or planned to be disturbed as part of a larger plan by construction activity, an application shall be applied for under the state's general permit for stormwater discharges associated with construction activity. The state utilizes a notice of intent for dischargers to obtain coverage under the general permit program for discharges associated with construction activities. These documents are subject to change and amendment and therefore the user should obtain the latest versions directly from the state department of environment and conservation, division of water pollution control. These may be obtained at the state's website.

(c)

If a state general NPDES permit is applied for, a copy of the notice of intent shall be sent by certified mail, hand delivered or as directed by the manager to the manager of the stormwater management section at least 30 days prior to the commencement of construction activities (i.e., the initial disturbance of soils associated with clearing, grading, excavating, or other construction activities). A copy of the notice of intent shall also be available for inspection by the manager or manager's representative on the construction site at all times during which construction activities are in progress. To seek coverage under the state department of environment and conservation general permit, the notice of intent shall be submitted to the following address:
