§ 34-61. Independent residential living facilities.

  • All facilities that contain more than 20 individual residential units in a single structure and which restricts occupancy of those units to residents over the age of 62 years or who are disabled and which is not required to obtain any state licensure or certification of that residential activity ("independent residential living facilities"), are hereby required, within 180 days of [December 5, 2016], to install and maintain fire alarms in all parts of the facility and emergency backup generators capable of providing sufficient power for heating, air-conditioning and lighting for a designated area within the facility of sufficient size and design which can provide temporary shelter and sanitary facilities for the immediate needs of those elderly or disabled residents living at the facility during periods in which the primary electrical power supply to the independent living facility is disrupted. This area shall include at least one refrigeration unit available for the storage of temperature-sensitive medications. Additionally, the main communication system, whether telephone or internet, shall also be connected to the stand-by power generator system to ensure its continued use by residents when the normal power source is not available.
