§ 32-56. Election required; general procedures.
(a)
Before the county shall have the right to pledge its faith and credit to the issuance of bonds under this article, and before the same shall be issued, the board of county commissioners shall request the county election commission to hold an election of the people of the county to determine whether the bonds shall be issued. Such request shall be made in writing, and the county election commission shall, promptly after the receipt of a written request from the board of county commissioners for such election, order an election to be held in the county so that the voters may express their wishes in regard to the issuance of the bonds.
(b)
It shall be the duty of the county election commission to publish notice of this election, together with the names of all officers, judges and clerks to hold the same, in some newspaper of general circulation in the county, not less than ten days nor more than 15 days prior to such election. Such publication shall be for not less than two issues of such paper. The notice may be published in conjunction with the notice of any municipal election or any other election to be held at the same time.
(c)
The election shall be held in the manner that other county elections are held in the county, and the voters in the election, save as otherwise herein provided, shall possess all the qualifications required of voters in county elections in the county. The election shall be held under all the restrictions surrounding county elections in the county. However, the county election commission shall not be required to hold any supplemental registration prior to the election, but all persons who are registered in the county and otherwise qualified shall be eligible to vote, and those who have moved their places of residence since the last supplemental registration shall be permitted to vote in the district and precinct in which they formerly registered, upon making affidavits to the officers of the election that they have moved their residence since the last supplemental registration and shall deliver to the officers of election their registration certificates. Such registration certificates shall be delivered by the officers of the election to the county election commission for cancellation. However, if any state or county or municipal election is to be held not less than 15 nor more than 60 days from the time when such request shall be made for an election by the board of county commissioners to the county election commission, the election upon such bonds may be held on the same day as such election, and the same election officers and the same voting precincts and places may be used for the bond election as are used for the state or county or municipal election; the bond proposition may appear on the same ballot used for the election, and if other elections are held on the same day, the election herein provided for shall be held jointly or concurrently therewith, and the ballots provided for in this article may be printed so as to include all propositions voted for in the same election and on the same ballot.
