§ 26-1. Erection or placement of residence.

  • No person shall be prohibited from erecting a permanent residence, or placing a mobile home, to be used as a residence, on any lot, provided such lot and residence meet the following requirements:

    (1)

    Such lot is at least one acre in size;

    (2)

    Such lot meets the state law requirements for subsurface sewage disposal systems;

    (3)

    Such structure is constructed and maintained in accordance with the local building codes; and

    (4)

    Such lot and residence are not part of an existing subdivision.
