§ 16-141. Violation and fines.

  • (a)

    Under the authority granted to the county by state law (T.C.A. § 7-63-201) upon failure of an owner, occupant or tenant to comply with the compliance notice to remedy the noncompliant conditions on the property, the responsible county health department official may issue a summons to the property owner, occupant or tenant to appear in Shelby County General Sessions Environmental Court for violation of this division. Such summons shall reference this article, the date and time of the violation, the name and address of the property owner, occupant or tenant, and the condition of the property.

    (b)

    Upon a finding of non-compliance by the court, the failure or refusal of the owner, occupant or tenant to remove and properly dispose of such garbage, litter, refuse and rubbish shall be a violation of this division and is punishable by a fine not to exceed $50.00 per violation, per day, plus court costs, as well as expenses for the remediation of the property.
